01The Agreement & Who May Enroll

These Terms and Conditions ("Terms") form an agreement between you — and, where applicable, your parent or legal guardian (together, "you") — and Topaz Studio Inc., operating in Ontario, Canada under the business name Topaz Art Academy (the "Academy," "we," "us," or "our"), in connection with (a) your enrollment in the Academy's classes and programs, including the free trial class, and (b) your use of our website (the site on which these Terms are posted; the "Website").

By booking a class, submitting the booking or contact form, creating an account, or using the Website in any way, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not book or use the Website.

Our programs are open to students aged 6 and up. We do not run classes for children under 6, and where a particular program lists a narrower age range, that range applies. If you or your student does not fall within the age range of the program you are booking, we may decline the booking in our discretion.

02Enrollment of Students Under 18

Students under the age of 18 enroll with the participation of a parent or legal guardian. By submitting the booking form on behalf of a minor, the parent or guardian:

  • confirms they are a parent, legal guardian, or other person authorized to consent on the student's behalf;
  • consents to the student's participation in the classes and programs;
  • agrees to these Terms on the student's behalf, including the payment, cancellation, and refund provisions; and
  • consents to the collection, use, and disclosure of the student's and the guardian's personal information as described in our Privacy Policy. Where the student is under 13, the guardian's consent stands in place of the student's own (the Privacy Commissioner of Canada does not consider individuals under 13 able to give meaningful consent).

We treat a student under 18 as unable to form a binding contract on their own. For paid enrollment, the parent or guardian is responsible for payment, and invoices are addressed to the parent or guardian where the student is a minor.

Drop-off and pick-up. For students under 18, a parent or guardian must drop off and pick up the student at each session. We ask that parents and guardians do not remain in the studio during class time, so that students can work independently.

We may suspend or terminate a student's enrollment at any time where participation creates a risk to the student's safety or to others, including where a student's conduct conflicts with our Code of Conduct. Refunds in such circumstances are determined under our Refund Policy.

03The Free Trial Class

The free trial class is offered to new students one time only, per person, and is subject to available capacity. It is a courtesy to introduce you to the Academy — not an obligation to provide it, and not a discount or credit against anything you later purchase.

  • One per student. A free trial may be booked once by each student. If we believe more than one free trial was requested on behalf of the same student (for example, through different email addresses), we may require paid enrollment from the first class onward.
  • No advance payment. The trial class itself is free. We do not require, collect, or store payment card details for the trial.
  • Payment only if you continue. If you decide to continue with paid classes after the trial, payment is collected at that time, on the terms set out in Section 4.
  • Attendance expected. We ask that you attend your booked trial. If you are unable to attend, please cancel at least 24 hours in advance so the spot can be offered to another student. See Section 5.

04Enrollment, Payment & Confirmations

  • Booking is a request. Submitting the online booking form creates a request to be enrolled. Your enrollment is confirmed when we (or our scheduling tool) sends you a confirmation containing your class details. We may not be able to confirm a booking where the class is full, and we will let you know as soon as possible if that happens.
  • Pricing. Fees for paid programs are set out at the time of booking (or by email on request). Prices are in Canadian dollars and include applicable taxes (HST). Prices in effect when you enroll apply to your enrollment, and any change applies from a future month with notice.
  • Payment. Paid enrollment is billed monthly in advance: the monthly fee is due on the first day of each month, payable in cash at the studio or by Interac e-Transfer to topazartacademy@gmail.com. We do not take debit or credit cards, and we never collect or store card or banking credentials. Each payment is confirmed with a receipt by email, and your enrollment is confirmed in writing by email (your confirmation, the current Terms, and your fee) — please keep that record.
  • Confirmations & reminders. You will receive email confirmations, reminders, and updates about your classes, sent via our scheduling service (Calendly) to the address you provided. We do not send marketing emails; if we ever do, we will ask your express opt-in first — see our Privacy Policy. Please keep your contact information up to date. If you update your email or phone with us, do so at least 48 hours before a class.
  • Your booking information. Your name, class, date/time, and confirmation details are shared with our scheduling service (Calendly) to run the booking — see our Privacy Policy.

05Scheduling, Cancellations & Missed Classes

  • How to change or cancel. You may reschedule or cancel a class through your booking portal, or by contacting us at topazartacademy@gmail.com or by phone.
  • Rescheduling within the month. You may reschedule any class within your enrolled month, subject to availability in another session of your program. Please let us know at least 24 hours ahead.
  • Missing a class. If you miss a class, or cancel with less than 24 hours' notice, you may attend one alternative session of the same program as a make-up, subject to availability, at no extra charge. Beyond that, the missed session is not made up. Your monthly enrollment continues in all other respects — see Section 6 and our Refund Policy.
  • The free trial. The 24-hour notice above applies to the free trial as a courtesy (no fee is charged, but we may decline future free-trial requests for repeated unexcused no-shows).
  • Group classes. Classes run on a group schedule set in advance. We may occasionally reschedule, cancel, or combine classes for operational or safety reasons (including weather). Where we cancel, your spot is preserved, you may choose an alternative session, or you may receive a refund for the affected sessions — per our Refund Policy.
  • Attendance requirements. Students must attend in a manner consistent with our Code of Conduct. For students under 18, a parent or guardian must check the student in and collect them at each session (see Section 2).

06Refunds

Our full refund and cancellation rules — including what happens when you cancel, when we cancel, the refund deadline, and how long refunds take — are set out in our standalone Refund Policy. It is incorporated into these Terms by reference and governs over anything in this section where the two differ.

In brief: the free trial is free; the monthly fee is due on the first of each month and is not refundable once the month has started; to stop next month's charge, cancel by 5 p.m. on the last day of the month; you may reschedule within the month and (subject to the Refund Policy) pause enrollment; and where we fail to provide classes you have paid for, you get your money back for the part not delivered.

07Code of Conduct

We run a studio for young people, and the studio must be safe, respectful, and welcoming for everyone. All students (and any parents or guardians on the premises) agree to:

  • be kind, respectful, and inclusive; harassment, bullying, or discrimination will not be tolerated;
  • follow the directions of instructors and studio staff;
  • use tools, materials, and equipment only as instructed, and only for their intended purpose;
  • look after the studio and its contents, and tell an instructor promptly about any damage or injury;
  • keep food and drink to break time and before class starts — not at the workstations while working with materials (see each program's intake information, which lists any specific allergies, PPE, or tool rules that apply);
  • comply with reasonable safety rules, including wearing any required protective equipment; and
  • keep mobile device use to what is permitted by the instructor.

We may ask a student or any other person to leave the studio, and we may suspend or terminate enrollment, where this Code is breached, where safety is at risk, or where continued participation is not in the best interests of the student or other participants. Refunds are determined under our Refund Policy.

08Photos, Video & Your Work

We love to celebrate our students' progress. From time to time we may take photos or video in the studio and may share images of students and their work on our Website and social media, and in press or promotional material.

Consent is always optional

We will never take your or your student's consent for photography as a condition of enrolling in or attending a class. It is always your choice.

When we do ask, we will explain exactly what may be photographed, where images may be used, and for how long — and you may say no, with no effect on your enrollment.

For students under 18, a parent or guardian gives or withholds consent on their behalf. If consent is given for a minor, we may photograph the minor, but we do not publish the minor's full name together with identifying images without the guardian's further written consent.

You may withdraw photography consent at any time by contacting us. Withdrawal stops further publication, but does not require us to remove images already published before your withdrawal (we will, however, act reasonably to remove images where requested and where practically possible).

We never sell your or your student's images, and we do not use them for anything beyond the purposes described when consent is asked.

09Student Intellectual Property

  • You keep your art. Work created by a student in our classes belongs to the student. We do not claim ownership of student work.
  • Our materials stay ours. Our lesson plans, curricula, handouts, instructional content, and brand materials remain the Academy's property and may not be copied, resold, or posted publicly.
  • A limited license to us. If you (or your guardian, for a minor) consent to us using images of your work under Section 8, or share your work with us (for example, to feature on our Website or in a student showcase), you grant us a non-exclusive, royalty-free, worldwide right to display and share that work for educational, promotional, and community purposes while you remain a student — and, for a reasonable period afterward, unless you ask us to stop. You may withdraw this license at any time by contacting us.
  • Submissions for reviews or shows. If you submit your work for a student showcase, portfolio review, or similar, you consent to our non-commercial educational display of it in connection with the program.

10Use of the Website

  • How you may use the Website. You may use the Website to learn about the Academy, book classes, and contact us. You agree not to: probe, scan, or interfere with the Website or its infrastructure; use automated means (bots, scrapers) to access it in a way that creates unreasonable load; attempt to access systems or data you are not authorized to reach; upload malicious code; or interfere with other users' use of the Website.
  • Booking forms. By submitting the booking or contact form you warrant that the information you provide is accurate and up to date, and — where you book on behalf of a minor — that you are authorized to act on their behalf.
  • Account information. Where the Website offers accounts (for example, through our scheduling service), you are responsible for keeping your login details confidential and for activity under your account.
  • Third-party links & services. The Website links to third-party services (including our scheduling tool, Calendly, and social media). We do not control those services and are not responsible for their content, availability, or their use of your information beyond what we have disclosed in our Privacy Policy. Each service's own terms apply.
  • Availability. The Website is provided on an "as available" basis. We may pause or change features at any time. Where this affects a booked class, we will notify you and resolve it fairly (see Section 5).
  • Intellectual property of the Website. The Website's design, text, graphics, and brand elements belong to the Academy or its licensors and may not be reproduced without written permission, except as permitted by law.

11Disclaimers & Limits on Results

The Academy provides art instruction and portfolio coaching. To the fullest extent permitted by law, the Website and our services are provided on an "as is" and "as available" basis, and we make no warranty that the Website will be uninterrupted, error-free, or secure against all access.

No guarantees about outcomes. Art education supports skill and portfolio development; it cannot guarantee any particular outcome, including acceptance to any school, program, or exhibition, or any level of artistic success. Nothing on the Website is a promise that enrollment will lead to admission anywhere. Results vary with each student.

Any statements on the Website about our programs describe what we teach and how; they are not individualized promises. Where we give general information about schools or programs, it is provided for convenience only — always check the institution directly for its own current requirements.

12Limitation of Liability

Some laws — including Ontario's — do not allow certain limits to be imposed in consumer contracts, and you may have rights that cannot be contracted away. To the extent permitted by law:

  • neither the Academy nor its owners, directors, employees, instructors, agents, or service providers is liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or opportunity, arising from your use of the Website or from enrollment in our programs, even if advised of the possibility of such damages;
  • the Academy's aggregate liability arising out of or relating to a booking, class, or program, whether in contract, tort (including negligence), or otherwise, will not exceed the amount you actually paid to us for the class or program that gives rise to the claim (or, for the free trial, the amount of a comparable paid session); and
  • nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for an unfair or unconscionable term in a consumer contract.

You are responsible for any damage you intentionally or carelessly cause to the studio, its equipment, or other students' property. We are not responsible for students' loss of personal belongings left in the studio; please take anything of value with you.

We are not a party to, and assume no responsibility for, transactions or agreements between you and third parties (including payment processors or the scheduling service) beyond the scope of these Terms, and we cannot control the performance of those third parties.

13Changes to These Terms

We may update these Terms and our Privacy Policy from time to time (for example, when we add programs, change pricing, or change how we handle your information). Where a change is material, we will notify you — by email to the address on file, or by a notice on the Website — at least 30 days before it takes effect, and it will take effect on the date we specify.

Changes do not apply retroactively to amounts already paid or sessions already delivered. If you disagree with a material change and it affects a program you are enrolled in, you may cancel in accordance with the then-current Refund Policy. Continuing to use the Website or attend classes after changes take effect is treated as acceptance of the updated terms.

14Governing Law, Disputes & Contact

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario have exclusive jurisdiction over any dispute arising from them.

Many consumer contracts in Ontario are subject to mandatory protections that cannot be waived, and you may have additional rights under Ontario's Consumer Protection Act, 2002 and other laws that are not affected by anything in these Terms.

We hope to resolve anything before it becomes a dispute. Please contact us first — most issues (scheduling, refunds, conduct) are straightforward to fix. Where a dispute cannot be resolved, either party may pursue the remedies available in law, including applying to the Small Claims Court of Ontario for claims within its jurisdiction.

If any part of these Terms is found to be invalid or unenforceable, the rest continues in effect, and the invalid part is read down to the minimum extent necessary to make it valid.

These Terms do not create any partnership, joint venture, or agency relationship, and no failure to exercise any right is a waiver of it.
